Terms of Service
Version 2026-09-10 · Last updated: September 10, 2026
These terms explain the deal for using Jefe. In plain English: Jefe turns what you say into a first draft of your paperwork, everything it produces is a draft you need to check before you send it, following the law where you work is your job not ours, and some features are paid. By using Jefe, you agree to these terms, including the arbitration agreement in section 12.
Who we are. Jefe is provided by Isaac Wallace-Menge, an individual doing business as a sole proprietor in California, United States. Wherever these terms say “we”, “us”, or “our”, they mean Isaac Wallace-Menge personally, and every protection, limit, and right in these terms applies to Isaac Wallace-Menge personally. If Jefe is later operated through a company, those words will also mean that company (see section 15). You can reach us at damsac.app@gmail.com.
1. What Jefe is
Jefe listens while you walk a job and turns what you said into notes and trade paperwork — estimates, invoices, work orders, condition, move-out and inspection reports. It is software, not a person: it drafts, and you decide what to send.
Jefe is actively developed. Features may change, be added, or be removed, and the service may occasionally be unavailable. Keep your own records of anything you can’t afford to lose.
2. Who can use it
You must be at least 18 and using Jefe for your own trade or business. We grant you a personal, non-transferable, non-exclusive licence to use Jefe on Apple-branded devices you own or control, subject to these terms and Apple’s Usage Rules. Jefe, its name, and everything in it remain ours.
3. Your paperwork is your responsibility
Jefe turns what you say into a first draft of an estimate, invoice, report, or notes. It is a starting point, not a finished professional document. You are responsible for reviewing, correcting, and verifying everything Jefe produces before you send it, price from it, or rely on it. Jefe does not provide legal, financial, tax, or professional advice, and we are not responsible for errors, omissions, prices, or decisions made from documents it generates.
This matters most where a document carries a legal consequence. A move-out or condition report may affect what is withheld from a tenant’s security deposit, and deposits are governed by landlord–tenant law that differs by state and runs against deadlines. Meeting those requirements is your responsibility, not Jefe’s.
Speech recognition mishears words, and prices, names, dates and codes are exactly the words worth checking. Read the draft.
4. Recording, consent, and your legal obligations
Jefe records audio while you walk, and keeps recording while your phone is locked or in your pocket until you finish the walk. Recording laws vary by state, and following them is your responsibility.
- Consent to record. Roughly a dozen states require every person in a conversation to agree before it may be recorded, and in several of them recording without that agreement is a criminal offence rather than merely a civil wrong. Some of those states — Massachusetts is the clearest example — prohibit secret recording regardless of whether anyone had any expectation of privacy, so “we were outdoors” is not a defence there. Elsewhere the risk concentrates where people do expect privacy, which ordinarily includes the inside of a home. The simplest rule, and the one we recommend everywhere: say out loud that you are recording, every time someone else is present.
- Recording people you are not talking to. If your phone captures a conversation you are not part of — people talking in another room while you work — that can be unlawful under federal and state wiretap law even in states that otherwise allow one-party consent, because those laws require the recorder to be a participant. Stop the walk when you are not the one talking.
- Licences and registrations. You are responsible for holding whatever licences, registrations, bonds, and insurance your trade and your jurisdiction require.
- Contract requirements. Many states regulate home improvement contracts, requiring a written agreement, signatures, and specific terms once a job passes a dollar threshold. A document Jefe produces is a draft and is not guaranteed to satisfy those requirements. Making sure the agreement you actually enter into complies is your responsibility.
- Other people’s information. A walk often captures gate codes, lockbox codes, addresses and client details. Handle that information the way its owner would expect — it isn’t yours, and it can open a door.
5. How your content is processed
Speech is transcribed on your device. To turn that transcript into a document, the resulting text is sent to Anthropic (the Claude API). Your audio recordings are not uploaded, and your content is not used to train AI models. See the Privacy Policy for the full picture, including who else is involved and for how long anything is kept.
6. Free use and subscriptions
Jefe includes a limited number of free walks so you can decide whether it works for you. Beyond that, continuing to record walks requires a Jefe Pro subscription, offered monthly or annually, sometimes with a free trial. Current prices are shown in the app before you buy.
- Apple bills you, not us. Subscriptions are sold through your Apple Account. We never see your card.
- They renew automatically until you cancel, at the price shown at purchase. Apple charges the renewal within 24 hours before each period ends. If you start on a free trial, nothing is charged until the trial ends.
- Cancel any time in Apple’s settings — Settings › your name › Subscriptions on your iPhone, or the Manage Subscription link in the app. We cannot cancel a subscription for you. Cancelling stops the next renewal; the current period runs to its end.
- Free trials: if you cancel before a trial ends you are not charged. Any unused part of a trial is forfeited if you buy a subscription during it.
- Refunds are Apple’s to give. Purchases are handled under Apple’s terms; request refunds through Apple.
- Prices can change. Apple will ask for your agreement before a price increase takes effect on your subscription, and you can cancel instead.
If a subscription lapses, your existing walks, notes and documents stay on your device — you just can’t record new walks until you resubscribe or free capacity is available.
7. Acceptable use
- Use Jefe lawfully and only for legitimate work.
- Don’t record people who haven’t agreed to it where their agreement is required (see section 4).
- Don’t capture other people’s private information without their permission.
- Don’t reverse-engineer, resell, or abuse the service or try to break it.
- Don’t attempt to circumvent usage limits or use the service other than through the app.
We may suspend or end your access if you break these rules, or if we reasonably believe your use puts other people or the service at risk.
8. Your content
Your walks, transcripts, photos, business details, and documents are yours. You grant us a worldwide, royalty-free, sublicensable licence to host, store, transmit and process that content, and to allow our service providers to do the same, solely to operate Jefe and produce your documents — for example, sending your transcript text to Anthropic to write an estimate. That licence ends when your content does. We don’t sell your content and we don’t use it to train AI models.
You confirm you have the right to give us that permission for whatever your walks capture.
9. No warranty
Jefe is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee it will be accurate, uninterrupted, or error-free. Some jurisdictions don’t allow certain warranty exclusions, so parts of this may not apply to you.
10. Limitation of liability
To the maximum extent allowed by law, we are not liable for any indirect, incidental, special, or consequential damages, or for lost profits, lost business, lost data, or inaccurate documents, arising from your use of Jefe.
To the maximum extent allowed by law, our total liability to you for any claim relating to Jefe is limited to the greater of the amount paid for Jefe in the twelve months before the claim, or fifty US dollars. Because Jefe is operated by an individual, this cap and the exclusions above apply to any claim against Isaac Wallace-Menge personally, whether the claim is framed in contract, tort, statute, or otherwise.
These limits do not apply to fraud or fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by our negligence, or anything else that cannot lawfully be limited or excluded. Nothing in these terms exempts us from responsibility for our own violation of law. Some jurisdictions don’t allow these limits, so parts of this may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Isaac Wallace-Menge personally, together with any company that later operates Jefe and any successors, assigns, contractors, and agents of either (together, the “indemnified parties”), from any third-party claim, demand, loss, liability, or expense — including reasonable legal fees — arising out of or relating to:
- your use of Jefe;
- the documents you produce with it, and how you use them;
- your recordings, including any claim that a recording was made without a consent the law required;
- your breach of these terms; or
- your violation of any law or of anyone else’s rights.
We’ll tell you about the claim within a reasonable time; a delay only reduces your obligation to the extent it actually prejudiced you. You will defend the claim at your own expense, using legal counsel we can reasonably agree on, and the indemnified parties may take part with their own counsel at their own expense. If you don’t take up the defence within a reasonable time, or if the claim alleges criminal conduct or seeks an order against us, we may defend it ourselves at your expense. You won’t settle any claim without our written agreement unless the settlement fully releases us, admits no fault on our part, and puts no obligation or payment on us.
If your trade carries commercial general liability or professional liability insurance, you’ll make a claim under it first where the policy covers the matter.
This section does not apply to the extent a claim arises from our own gross negligence or wilful misconduct.
12. Disputes — arbitration and class waiver
Please read this section carefully. It affects how disputes between us are resolved and gives up your right to a jury trial and to take part in a class action.
Talk to us first. If something goes wrong, email damsac.app@gmail.com with a description and what you’d like done. Most things end here. Please give us 30 days to sort it out before starting a formal proceeding.
Arbitration. If we can’t resolve it, you and we agree that any dispute relating to Jefe or these terms — including any claim against Isaac Wallace-Menge personally or against any company that later operates Jefe — will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before one arbitrator, in the county where you live or by video or telephone, whichever you prefer. The Federal Arbitration Act governs this section. The arbitrator decides all issues except that a court decides whether the class waiver below is enforceable.
Individual claims only. Claims must be brought on an individual basis. No class actions, collective actions, or representative proceedings. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If a court decides this paragraph is unenforceable as to a particular claim, that claim — and only that claim — goes to court, and the rest of this section still applies to everything else.
Small claims and injunctions. Either of us may bring an individual claim in small-claims court instead, and either of us may ask a court for an injunction to stop misuse of the service or infringement of intellectual property.
Opting out. You can opt out of arbitration and the class waiver by emailing damsac.app@gmail.com with the subject line “Arbitration Opt-Out” within 30 days of first agreeing to these terms. Opting out costs you nothing and doesn’t affect anything else here.
If arbitration doesn’t apply to a dispute, it will be brought exclusively in the state or federal courts located in California, and you and we consent to their jurisdiction — except that this does not deprive you of the protection of the consumer laws of the state where you live.
13. Changes and termination
We may update these terms, change the service, or discontinue it. For material changes we’ll update the version and date above and tell you in the app before they take effect, and continuing to use Jefe after that means you accept them. If you don’t, stop using Jefe — cancel any subscription and delete the app. Your walks and documents live on your device, so they stay with you.
14. Apple
These terms are between you and us, not Apple. Apple is not a party to them and has no obligation to provide support for Jefe — we are solely responsible for Jefe, for supporting it, and for any warranty claims, product liability claims, third-party intellectual property claims, or claims under consumer protection law relating to it. If Jefe fails to conform to any applicable warranty, you may tell Apple and Apple will refund the purchase price; to the maximum extent allowed by law, Apple has no other warranty obligation.
You may use Jefe only on Apple-branded devices you own or control and as permitted by the Usage Rules in the App Store Terms of Service. You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
15. General
- The whole agreement. These terms and the Privacy Policy are the entire agreement between us about Jefe, and they replace anything said elsewhere — including on our website, in the App Store, or in marketing. Marketing copy describes the product; this document sets the terms.
- If part of this is unenforceable, it will be limited or reformed to the minimum extent needed to make it enforceable, and the rest of these terms stay in force.
- What survives. Sections 3, 4, and 8 through 16 continue to apply after you stop using Jefe.
- Assignment. You may not transfer these terms. We may transfer them to an affiliate or to a successor in connection with forming a company, a merger, an acquisition, or a sale of the business, and your rights are unaffected. After any such transfer, the protections in sections 9 through 12 continue to apply to Isaac Wallace-Menge personally for everything that happened before it, as well as to the successor.
- No waiver. If we don’t enforce something straight away, we haven’t given up the right to enforce it later.
- Things outside our control. We’re not liable for delays or failures caused by events beyond our reasonable control, including outages at Apple, Anthropic, or our hosting providers.
- Feedback. If you send us a suggestion, we can use it freely and owe you nothing for it. You keep no rights in it, and we’re not taking any rights in your walks or documents.
- Notices. We’ll reach you in the app or, if you’ve given us an email address, by email. Reach us at damsac.app@gmail.com.
16. Governing law
These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs section 12. If you are a consumer resident in another state, this does not take away the protection of that state’s mandatory consumer laws.
